Residence Permit Status Conversion

GENERAL

  1. A Residence Permit status granted to a Foreign National may be converted.
  2. Residence Permit that may be converted are:
    1. A visitor Permit to a temporary Residence Permit;
    2. A temporary Residence Permit to a permanent Residence Permit.
  3. The Residence Permit status conversion as referred to in point 2 is determined by a Ministerial Decree.

REQUIREMENTS

  1. A Visitor Permit Status Conversion to a Temporary Residence Permit
    1. Application for a Visitor Permit status conversion to a Temporary Residence Permit is submitted since the Foreign National is in Indonesian Territory.
    2. A Visitor Permit Status Conversion to a Temporary Residence Permit may be granted to a Foreign National who:
      1. make investment;
      2. work as an expert;
      3. carry out duties as a cleric;
      4. participate in an education and training activity;
      5. conduct scientific research;
      6. join to live with her Indonesian husband or his Indonesian wife;
      7. join to live with husband or wife holding a Temporary or Permanent Residence Permit;
      8. join to live with parent, for a child with foreign citizenship who has a legal family relationship with Indonesian parent;
      9. join to live with parent holding a Temporary or Permanent Residence Permit, for a child who is under 18 (eighteen) years of age and unmarried;
      10. is considered to benefit the people welfare and/or give benefit for humanitarian reason, after acquiring Minister's consideration;
      11. is aimed at regaining his/her Indonesian citizenship in accordance with prevailing laws and regulations; and/or
      12. is an elderly foreign tourist.
    3. For Foreign National who make investment, work as an expert and carry out duties as a cleric should attach the following documents:
      1. Sponsorship letter from the Sponsor;
      2. A legal and valid passport and the copy of it;
      3. Statement of residency;
      4. Recommendation from a related ministry or a non-ministerial government institution;
      5. Foreign Manpower Employment Plan (RPTKA) from the authorized agency;
    4. For Foreign National who participate in an education and training activity and conduct scientific research should attach the following documents:
      1. Sponsorship letter from the Sponsor;
      2. A legal and valid passport and the copy of it;
      3. Statement of residency;
      4. Recommendation from a related ministry or a non-ministerial government institution;
      5. Recommendation for study/ research from the authorized agency, such as Ministry of Education and Culture (Kemendiknas)/ Indonesian Institute of Sciences (LIPI);
    5. A child who is born in Indonesian Territory to a father and/or mother holding a temporary Residence Permit should attach the following documents:
      1. a sponsorship letter from the Sponsor;
      2. a legal and valid passport and the copy of it;
      3. a copy of birth certificate;
      4. a copy of his/her parent's marriage certificate;
      5. a copy of his/her father's and/or mother's passport which is legal and valid;
      6. a copy of the father's and/or mother's temporary Residence Permit which is valid.
    6. A Foreign National who is legally married to an Indonesian citizen should attach the following documents:
      1. a legal and valid passport and the copy of it;
      2. an application from the Indonesian husband or wife;
      3. statement of residency;
      4. a copy of marriage certificate;
      5. a copy of marriage report from the Department of Population and Civil Registration for a marriage performed overseas;
      6. a copy of valid national Identity Card of the Indonesian husband or wife;
      7. a copy of the Indonesian husband's or wife's family card.
    7. A child of Foreign National who is legally married to an Indonesian citizen should attach the following documents:
      1. a legal and valid passport and the copy of it;
      2. application from his/her Indonesian father and/or mother;
      3. statement of residency;
      4. a copy of birth certificate;
      5. a copy of his/her parent's marriage certificate;
      6. a copy of valid national Identity Card of his/her Indonesian father or mother;
      7. a copy of his/her Indonesian father's or mother's family card.
    8. A Foreign National who join to live with husband or wife holding a temporary Residence Permit should attach the following documents:
      1. a legal and valid passport and the copy of it;
      2. a sponsorship letter from the sponsor;
      3. a statement of residency;
      4. a copy of marriage certificate;
      5. a copy of husband's or wife's temporary Residence Permit.
    9. A child of foreign citizenship who join to live with his/her Indonesian father and/or mother should attach the following documents:
      1. a legal and valid passport and the copy of it;
      2. an application from his/her Indonesian father and/or mother;
      3. a sponsorship letter from the sponsor;
      4. a statement of residency;
      5. birth certificate;
      6. a copy of his/her parent's marriage certificate;
      7. a copy of valid National Identity Card of his/her Indonesian father and/or mother;
      8. a copy of his/her Indonesian father's and/or mother's family card.
    10. A child under 18 (eighteen) years of age and unmarried who join to live with his/her father and/or mother holding temporary or Permanent Residence Permit should attach the following documents:
      1. a legal and valid passport and the copy of it;
      2. a sponsorship letter from the Sponsor;
      3. a statement of residency;
      4. a copy of birth certificate;
      5. a copy of his/her parent's marriage certificate;
      6. a copy of legal and valid passport of his/her father and/or mother;
      7. a copy of temporary Residence Permit of his/her father and/or mother.
    11. A Foreign National who was formerly an Indonesian citizen should attach the following documents:
      1. a legal and valid passport and a copy of it;
      2. a sponsorship letter from the Sponsor;
      3. a statement of residency;
      4. an evidence showing that he/she was Indonesian citizen.
    12. An elderly foreign tourist should attach the following documents:
      1. a legal and valid passport and a copy of it;
      2. a sponsorship letter from the Sponsor;
      3. a statement of residency;
      4. a sponsorship letter from the Travel Agent appointed by the Ministry of Culture and Tourism.
  2. A Temporary Residence Permit Status Conversion to a Permanent Residence Permit
    1. A Temporary Residence Permit Status Conversion to a Permanent Residence Permit is granted to a Foreign National who is:
      1. a cleric;
      2. a worker;
      3. an investor;
      4. an elderly foreign tourist;
      5. joining to live with her husband or his wife holding a Permanent Residence Permit;
      6. joining to live with his/her parent holding a Permanent Residence Permit, for a child under 18 (eighteen) years of age who is unmarried, and;
      7. a former Indonesian citizen.
    2. A temporary Residence Permit status conversion to a Permanent Residence Permit may also be granted to a Foreign National who:
      1. join to live with her Indonesian husband or his Indonesian wife which has been married to him/her for at least 2 (two) years;
      2. join to live with his/her father and/or mother, for a child of foreign citizenship, who has legal family relationship with his/her Indonesian father and/or mother;
      3. is a child, under 18 (eighteen) years of age and unmarried, of a Foreign National who is legally married to an Indonesian citizen.
    3. A temporary Residence Permit status conversion to a Permanent Residence Permit for a Foreign National, who is a cleric, worker, investor, and foreign elderly tourist, is granted after he/she has resided in Indonesian Territory for a minimum of 3 (three) consecutive years since the temporary Residence Permit was granted.
    4. A Foreign National who is a cleric, worker, and investor, should attach the following documents:
      1. a valid and legal passport;
      2. a copy of valid temporary Residence Permit;
      3. a statement of residency;
      4. an integration statement signed by him/her; and
      5. a recommendation from the related ministry or other non-ministerial government institution.
    5. An elderly foreign tourist should attach the following documents:
      1. a legal and valid passport and a copy of it;
      2. a copy of valid temporary Residence Permit;
      3. a sponsorship letter from the Sponsor;
      4. a statement of residency;
      5. a statement of integration signed by him/her;
      6. a sponsorship letter from the Travel Agent appointed by the Ministry of Culture and Tourism.
    6. A Foreign National who join to live with her husband/ his wife holding a Permanent Residence Permit should attach the following documents:
      1. a legal and valid passport;
      2. a copy of valid temporary Residence Permit;
      3. a statement of residency;
      4. a statement of integration signed by him/her;
      5. a sponsorship letter from the Sponsor;
      6. a copy of marriage certificate;
      7. a copy of legal and valid passport of husband and/or wife;
      8. a copy of valid Permanent Residence Permit of husband and/or wife;
      9. a decision concerning his/her Residence Permit status conversion.
    7. A child who join to live with his/her parent holding a Permanent Residence Permit, for a child under 18 (eighteen) years of age and unmarried, should attach the following documents:
      1. a legal and valid passport;
      2. a copy of valid temporary Residence Permit;
      3. a statement of residency;
      4. a statement of integration signed by him/her;
      5. a sponsorship letter from the Sponsor;
      6. a copy of birth certificate;
      7. a copy of his/her parent's marriage certificate;
      8. a copy of legal and valid passport of his/her father and/or mother;
      9. a copy of valid Permanent Residence Permit of his/her father and/or mother.
    8. A Foreign National who join to live with his Indonesian wife or her Indonesian husband should attach the following documents:
      1. a legal and valid passport;
      2. a copy of valid temporary Residence Permit;
      3. a statement of residency;
      4. a statement of integration signed by him/her;
      5. an application from her Indonesian husband or his Indonesian wife;
      6. a copy of marriage certificate;
      7. a copy of marriage report from the authorized institution for a marriage performed overseas;
      8. a copy of valid National Identity Card of his/her Indonesian husband or wife;
      9. a copy Indonesian husband's or wife's family card;
    9. A child of foreign citizenship, from a legal marriage to an Indonesian citizen, who join to live with his/her Indonesian father and/or mother should attach the following documents:
      1. a legal and valid passport;
      2. a copy of valid temporary Residence Permit;
      3. a statement of residency;
      4. a statement of integration signed by him/her;
      5. an application from the Indonesian father or mother;
      6. a copy of his/her parent's marriage certificate;
      7. a copy of valid National Identity Card of his/her Indonesian father or mother;
      8. a copy of his/her Indonesian father's or mother's family card.

 

PROCEDURE

Application for a Visitor Permit status conversion to a temporary Residence Permit and a temporary Residence Permit status conversion to a permanent Residence Permit are submitted by the Sponsor to the Chief of Immigration Office whose work area covers the Foreign National’s residence.
